Navion Value Engine Terms of Use

1. Purpose & Estimates

The Calculator is an interactive resource provided for demonstration and planning purposes. The outputs generated are estimates based on your inputs and our baseline industry assumptions. They are intended to help guide our conversations and do not represent guaranteed outcomes, actual savings, or professional financial advice. Because every fuel transport business is unique, the Calculator is provided on an "as is" and "as available" basis without formal warranties of any kind.

2. Proprietary Rights & Intellectual Property

The logic, algorithms, and design powering the Calculator are proprietary to Navion. We invite you to use this tool for evaluating our services internally. In exchange, we ask that you respect our intellectual property by not copying, reverse-engineering, or using the Calculator's underlying formulas to build a competitive product.

3. Confidentiality of Industry Intelligence

The Calculator contains proprietary data, benchmarks, and logic derived from Navion's experience in the fuel transport sector. You agree to maintain the confidentiality of the model's structure and benchmark data. You shall not disclose or share screenshots of the internal logic or specific industry benchmarks with any third party without Navion's prior written consent.

4. Email-Linked Access & Marketing Consent

To unlock advanced scenarios, we require email or SMS validation. This secure link associates your calculator session with your prospect profile in our systems. By authenticating, you consent to receive communications, including marketing communications, from Navion regarding your ROI results and our services. You may opt out of these communications at any time.

5. Acceptable Use & Security

You agree not to:

• Introduce any harmful code, viruses, or malware into the Calculator.
• Attempt to gain unauthorized access to any data, accounts, or systems connected to the Calculator.
• Use any automated system (e.g., "robots" or "spiders") to access the Calculator in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.

6. Termination of Access

Navion reserves the right, in its sole discretion, to terminate or revoke your access to the Calculator at any time and for any reason, including but not limited to a breach of these Terms or if Navion determines that such access is no longer in its best business interest.

7. Limitation of Liability

While we strive to provide a highly accurate and useful tool, Navion cannot assume liability for business decisions made based on its outputs. To the maximum extent permitted by law, Navion will not be liable for any indirect, incidental, or consequential damages arising from your use of the Calculator.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
